Allgemeine Geschäftsbedingungen (AGB)
der PALMARA REISEKUNST LLC
1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Vermittlungsleistungen der PALMARA REISEKUNST LLC (nachfolgend „PALMARA REISEKUNST“), die von Kunden in Anspruch genommen werden. Abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, PALMARA REISEKUNST stimmt deren Geltung ausdrücklich schriftlich zu.
2. Stellung von PALMARA REISEKUNST
PALMARA REISEKUNST organisiert die Unterkunft sowie den organisatorischen Rahmen der Gruppenreise und tritt als Vermittler weiterer Leistungen auf.
Zusatzleistungen wie Ausflüge, Sport- und Freizeitangebote oder Events werden von sorgfältig ausgewählten Partnern vor Ort erbracht.
3. Vertragsabschluss
Mit der Buchungsanfrage erteilt der Kunde PALMARA REISEKUNST den Auftrag zur Organisation der Gruppenreise. Der Vertrag zwischen dem Kunden und PALMARA REISEKUNST kommt mit der Bestätigung der Buchung zustande. Verträge über Zusatzleistungen entstehen ausschließlich zwischen dem Kunden und den jeweiligen Partnern vor Ort.
4. Leistungen von PALMARA REISEKUNST
1. PALMARA REISEKUNST übernimmt die Organisation der Unterkunft sowie des gesamten Rahmens der Gruppenreise (z. B. Transfers, Koordination der Teilnehmer, allgemeine Betreuung).
2. Zusatzleistungen (z. B. Tagesausflüge, Sport- und Freizeitaktivitäten, Events) werden durch erfahrene und zuverlässige Partner vor Ort erbracht.
3. Während der gesamten Reise steht den Teilnehmern eine persönliche Reisehostess als Ansprechpartnerin zur Verfügung. Sie begleitet die Gruppe, ist bei allen Ausflügen anwesend und sorgt dafür, dass eventuelle Probleme sofort gelöst werden.
4. So ist eine durchgehende Betreuung und VIP-Service jederzeit gewährleistet – von der Ankunft bis zur sicheren Rückkehr in die Unterkunft.
5. Preise und Zahlung
Alle Preise verstehen sich, sofern nicht ausdrücklich anders angegeben, in der angegebenen Währung und inklusive etwaiger Organisations- oder Vermittlungsgebühren. Zahlungsmodalitäten richten sich nach den Vorgaben von PALMARA REISEKUNST sowie nach den jeweiligen Bedingungen der Partner. PALMARA REISEKUNST ist berechtigt, Anzahlungen oder vollständige Zahlungen im Namen der Partner einzuziehen.
6. Rücktritt, Stornierung und Teilnehmerwechsel
1. Für Rücktritt, Umbuchung oder Stornierung gelten grundsätzlich die jeweiligen Bedingungen der Partner.
2. Zusätzlich bietet PALMARA REISEKUNST eine kulante Sonderregelung:
– Kann ein Teilnehmer die Reise nicht antreten, so ist er berechtigt, bis spätestens 7 Tage vor Reisebeginn einen Ersatzteilnehmer zu stellen.
– Der Wechsel ist gegen eine Bearbeitungsgebühr von 100 EUR möglich.

– Weitere Kosten entstehen nicht, sofern der Ersatzteilnehmer die bestehenden Vertragsbedingungen übernimmt.
3. Erfolgt kein Teilnehmerwechsel, gelten ausschließlich die Stornierungsbedingungen der jeweiligen Partner.
7. Verantwortung und Haftung
PALMARA REISEKUNST ist für die Organisation der Unterkunft und des Rahmens der Gruppenreise verantwortlich.
Die Durchführung der Zusatzleistungen liegt in der Verantwortung der jeweiligen Partner vor Ort, die dafür stets eine Reisehostess bzw. Ansprechpartnerin zur Seite stellen.
Hinweis: PALMARA REISEKUNST selbst übernimmt für die Durchführung der Zusatzleistungen keine Haftung.
8. Versicherungen
Der Abschluss von Reiseversicherungen (z. B. Reiserücktrittsversicherung, Auslandskrankenversicherung) liegt in der Verantwortung des Kunden. PALMARA REISEKUNST empfiehlt dringend den Abschluss entsprechender Versicherungen.
Hinweis: Bei Bezahlung mit Kreditkarte sind häufig bereits bestimmte Reiseversicherungen enthalten. Kunden sollten die Bedingungen ihrer Kreditkarte prüfen.
Alternativ empfiehlt PALMARA REISEKUNST die ADAC Reiseversicherung, zu der auf unserer Webseite ein entsprechender Link bereitgestellt wird. Diese Empfehlung erfolgt unverbindlich; eine Verpflichtung zum Abschluss einer Versicherung besteht nicht.
9. Rechtswahl und Gerichtsstand
Für diese AGB und sämtliche Rechtsbeziehungen zwischen PALMARA REISEKUNST und dem Kunden gilt das Recht des Bundesstaates Albuquerque, USA.
Gerichtsstand ist, soweit gesetzlich zulässig, Wilmington, Delaware, USA.
10. Salvatorische Klausel
Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, so bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die Stelle der unwirksamen Bestimmung tritt eine wirksame Regelung, die dem wirtschaftlichen Zweck am nächsten kommt.

General Terms and Conditions (GTC)
of PALMARA REISEKUNST LLC
1. Scope
These General Terms and Conditions apply to all services provided by PALMARA REISEKUNST LLC (hereinafter “PALMARA REISEKUNST”) that are used by customers. Deviating conditions of the customer are not recognized unless PALMARA REISEKUNST expressly agrees to their validity in writing.
2. Role of PALMARA REISEKUNST
PALMARA REISEKUNST organizes the accommodation as well as the framework of the group trip and acts as an intermediary for additional services.
Additional services such as excursions, sports and leisure activities or events are provided by carefully selected local partners.

3. Conclusion of contract
By submitting a booking request, the customer commissions PALMARA REISEKUNST to organize the group trip. The contract between the customer and PALMARA REISEKUNST comes into effect with the confirmation of the booking. Contracts for additional services are concluded exclusively between the customer and the respective local partners.
4. Services of PALMARA REISEKUNST
1. PALMARA REISEKUNST organizes the accommodation and the entire framework of the group trip (e.g. transfers, coordination of participants, general support).
2. Additional services (e.g. day trips, sports and leisure activities, events) are provided by experienced and reliable partners on site.
3. Throughout the trip, a personal hostess is available to the participants as a contact person. She accompanies the group, is present at all excursions and ensures that any problems are resolved immediately.
4. This ensures continuous care and VIP service at all times – from arrival until the safe return to the accommodation.
5. Prices and payment
All prices are quoted, unless expressly stated otherwise, in the indicated currency and include any organizational or mediation fees. Payment modalities are determined by the conditions of PALMARA REISEKUNST as well as those of the respective partners. PALMARA REISEKUNST is entitled to collect deposits or full payments on behalf of the partners.
6. Withdrawal, cancellation and participant substitution
1. The cancellation, rebooking or withdrawal conditions of the respective partners generally apply.
2. In addition, PALMARA REISEKUNST offers a generous special arrangement:
– If a participant is unable to attend the trip, he or she is entitled to provide a substitute participant up to 7 days before the start of the trip.
– The change is possible for a processing fee of EUR 100.
– No further costs will be incurred, provided that the substitute participant accepts the existing contractual conditions.
3. If no substitute participant is provided, only the cancellation conditions of the respective partners apply.
7. Responsibility and liability
PALMARA REISEKUNST is responsible for organizing the accommodation and the overall framework of the group trip.
The execution of additional services is the responsibility of the respective partners on site, who always provide a hostess or contact person to accompany the group.
Note: PALMARA REISEKUNST itself does not assume liability for the execution of additional services.
8. Insurance
Taking out travel insurance (e.g. travel cancellation insurance, international health insurance) is the responsibility of the customer. PALMARA REISEKUNST strongly recommends taking out appropriate insurance.
Note: When paying by credit card, certain travel insurance policies are often already included. Customers should check the conditions of their credit card.
For German customers, PALMARA REISEKUNST additionally recommends ADAC travel insurance, with a corresponding link provided on our website. This recommendation is non-binding;

there is no obligation to take out insurance.
9. Governing law and jurisdiction
These GTC and all legal relationships between PALMARA REISEKUNST and the customer are governed by the law of the State of Albuquerque USA.
The place of jurisdiction is Wilmington, Delaware, USA, insofar as legally permissible.
10. Severability clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.
